Child Abuse Essay in English 300 words
In the wake of the outrage over the kidnapping, rape and murder of a minor girl in Kathua, the Union Cabinet approved the promulgation of the Criminal Law (Amendment) Ordinance, 2018. This law allowed courts to award death penalty to those convicted of raping children below 12 years of age.
According to data of the National Crime Records Bureau (NCRB) for 2016, incidents of rape of children increased by over 82 per cent compared to 2015. The Ordinance provides for stringent punishment for rape of girls under 12 with a minimum of 20 years imprisonment or imprisonment for rest of life and the maximum of death. In case of gang rape of a girl below 12 years, the minimum punishment will be imprisonment for the “rest of life” and the maximum, death sentence.
There are certain benefits from this law. Like it will provide effective deterrence against the commission of rape, remove the case of under-reporting of rape cases. But there is also a negative consequence of this law. Like it is not a gender-neutral law because it does not talk about boys below 12 years of age, there is no proper access to justice for poor people, does not consider under-reporting of cases.
Deterrence of the crime and the victim’s access to justice require both better implementation of existing laws and systemic changes. Speedy justice and higher conviction rate will act as a crime deterrent in any criminal and civil cases. Moreover, the focus of the law should also be on victim support and rehabilitation so that victim can be facilitated at every stage from the police station, to hospital and courts.
